Public Offer Agreement

By registering on the HostDatum website or making a payment for services, you accept this agreement. Please read this contract carefully before proceeding with registration or service usage.
1. Terms and Definitions
- "HostDatum" – The web-based data hosting company providing the services.
"Customer" – Any individual or entity entering into a contractual agreement with HostDatum for services.
"Services" – Hosting solutions, including VPS, VDS, dedicated servers, cloud hosting, domain registration, SSL certificates, and related technical services.
"Account" – The unique customer profile created upon registration on the HostDatum platform.
"User" – Any individual authorized by the Customer to access and utilize the Services.
"Data" – Any digital files, documents, or content stored or processed using HostDatum services.
"Control Panel" – The web-based interface allowing management of hosting services.
"DNS Server" – The system that converts domain names into IP addresses.
"Virtual Private Cloud (VPC)" – A dedicated cloud-based hosting infrastructure.
"Confidential Information" – Non-public, proprietary, or sensitive data shared between parties.
"Intellectual Property" – All proprietary rights, including copyrights, trademarks, and patents owned by HostDatum.
"Force Majeure" – Events beyond reasonable control, including natural disasters, governmental actions, or cyberattacks.
"Termination" – The cancellation of the service agreement before the agreed expiration date.
2. General Provisions
This agreement governs the provision of web hosting and related services.
Customers must complete registration and provide accurate personal information.
Services are available on a paid or trial basis, depending on the selected plan.
The contract remains effective until terminated by either party.
HostDatum reserves the right to modify service terms and pricing with prior notice.
3. Customer Obligations
Payment: Customers must ensure timely payment for all services.
Compliance: Customers must adhere to all applicable laws and regulations.
Data Legality: Customers must ensure that all hosted content is lawful and non-infringing.
Security: Customers must not engage in activities that could compromise server stability or security.
Cooperation: Customers must provide necessary information for technical support when required.
4. HostDatum Obligations
Service Provision: HostDatum will provide high-quality hosting solutions with reasonable uptime.
Security: HostDatum will implement security measures to protect customer data.
Technical Support: 24/7 support will be available through various channels.
Data Backup: HostDatum will perform regular backups but does not guarantee full data recovery.
5. Payment Terms
Customers agree to pay the fees outlined in their service plan.
Payment cycles include monthly, quarterly, or annual billing.
Late payments may result in service suspension or termination.
Taxes and additional fees may apply based on jurisdiction.
6. Force Majeure
Neither party will be liable for failure to perform obligations due to uncontrollable events.
If a Force Majeure event lasts more than 30 days, either party may terminate the agreement.
7. Termination and Amendments
Either party may terminate the agreement with prior written notice.
HostDatum reserves the right to terminate accounts involved in violations of the terms.
Amendments to the agreement will be communicated via email or website updates.
8. Limitation of Liability
HostDatum is not liable for indirect, incidental, or consequential damages.
The maximum liability for any claim is limited to the amount paid for the service within the last six months.
9. Governing Law and Jurisdiction
